FMLA Family Military Leave Now Available to Additional Military Families

On October 28, 2009, President Obama signed into law the National Defense Authorization Act for Fiscal Year 2010 (P.L. 111-84), which among other things amends the Family and Medical Leave Act (FMLA).

This military spending law expands the FMLA provisions about family military leave.

The amendments became effective upon the signing of the law. The FMLA now allows family members of some active duty military members to take qualifying exigency leave, and family members of some veterans to take military caregiver leave.

This is the second military spending law that amended the FMLA. In January 2008, President Bush signed a law that added the family military leave provisions to the FMLA.
